AVAILABILITY

Our system automatically acknowledges receipt of your order, but mere acknowledgement of receipt does not constitute acceptance of your offer to purchase the item(s).

Although we endeavour to hold stock of all items on our site, this cannot be guaranteed. Therefore, by acknowledging receipt of your order we are not creating a binding obligation to supply what you have ordered but which we do not have in stock. Designs on certain accessory items may vary, according to supply.

In the event of unavailability for whatever reason we will advise you of the position when we receive your order and await your subsequent instructions. We reserve the right to amend or substitute the contents of our products without giving notice.

We reserve the right to cancel a class. If there are insufficient numbers for example.

CUSTOMS

When ordering goods from our site for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from our site, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

ELECTRONIC COMMUNICATIONS

When you visit our site or shop online on our site, or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on our site. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged and you must retain all copyright and other proprietary notices contained in such materials.

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any user of our site, or by anyone who may be informed of any of its contents.

  • All videos, educational materials, art/activity materials and/or products supplied are intended for execution under adult supervision at all times. Art Academy Ireland, Da Vinci Box and Da Vinci Box Junior accepts no liability for harm or injury caused to humans, animals, furniture or other belongings and property. It is the responsibility of the purchaser to insure clothing, property, belongings for example furniture are protected during the art lesson and that children are supervised at all times while online, watching the videos, using the materials supplied and undergoing the activities set out.
  • All products and and classes are subject to government health advice. Those booking or purchasing from Art Academy Ireland must comply will up to date health and safety guidelines.

Nothing in these Terms and Conditions affects our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law. Further, nothing in these Terms and Conditions affects any of those statutory rights you have as a consumer which may not be excluded or altered.

INFORMATION ABOUT YOU

We respect your privacy and will only process personal data you provide to us or we obtain from you in accordance with applicable privacy law as detailed in our Privacy Policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. We do not want you to, and you should not, send any confidential or proprietary information to us via our site. You agree that any information or materials that you or individuals acting on your behalf provide to us will not be considered confidential or proprietary (subject always to applicable law and the terms of our privacy policy). You further recognise that we do not want you to, and you warrant that you shall not, provide any information or materials to us that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another person.

All photography and video by attendees is strictly prohibited at Art Academy where minors are in attendance.  Taking of photography or video by attendees at Art Academy where only adults attend is strictly prohibited unless express prior

consent is given. Photography and video of models or tutors is always prohibited.

TERMINATION

We will determine, in our discretion, whether there has been a breach of these Terms and Conditions through your use of our site. When a breach has occurred, we may take such action as we deem appropriate.

A breach of these Terms and Conditions may result in our taking all or any of the following actions:

  • immediate, temporary or permanent withdrawal of your right to use our site;
  • issue of a warning to you;
  • legal proceedings against you for payment for goods (if applicable), payment of monetary compensation and/or reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  • further legal action against you; and
  • disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of these Terms and Conditions. The responses described above are not limited, and we may take any other action we reasonably deem appropriate.

Art Academy reserves the right of refusal or removal of students from its workshops, classes or events both online and in person. All students must respect the venue, staff, equipment, art materials, other students, models, guests, guest instructors and artists, interpreters, other staff working within a venue and art work and materials and belongings of others. Any behavior deemed inappropriate, threatening, abusive, derogatory or dangerous may result in removal from an event, workshop, class with immediate effect. Art Academy seeks to foster a pleasant and creative environment. Any behavior that takes away or is perceived as such by Art Academy from the enjoyment of this environment may result in immediate removal from the event workshop or class.

VARIATIONS

We may revise these Terms and Conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we may make, as they are binding on you. Some of the provisions contained in these Terms and Conditions may also be superseded by provisions or notices published elsewhere on our site.

JURISDICTION AND APPLICABLE LAW

These Terms and Conditions are governed by Irish law and the Irish courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site.

We retain the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country. Similarly, you may have the right to bring proceedings in your country of residence.

DELIVERY

We aim to dispatch all orders within 5 working days from receipt of order. We will dispatch orders using either An Post or courier for large orders. An Post aim to deliver most to Ireland by next working day but do not guarantee this. An Post also state that they aim to deliver to European destinations within three to five working days, major cities worldwide within five days and other destinations within seven.

In any instance, we request that you allow up to 10 working days for delivery of your order before contacting us about an order not received. We will always do our utmost to inform you of any potential delay.

RETURNS, CANCELLATIONS AND REPLACEMENTS

We are sure you will be delighted with your purchases from Art Academy but occasions may occur where you feel it necessary to return or cancel an item or workshop/class. We aim to keep this process as simple and easy as possible.

All customers in the European Union are entitled to a statutory cooling-off period of 14 business days, calculated from the date of receipt by you of the products. This means that you must inform us  in writing or via email create@artacademy.ie within 14 days of receipt that you wish to cancel the contract. You must then return the products to us within a further 14 days.

You have the right to cancel the contract for the purchase of any item or booking within seven working days of delivery. EU customers are also entitled to a statutory cooling off period of 7 days.  Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you by mistake or the item is faulty.

The returned or cancelled items must be in their original condition, in the original packaging and with original labels and tags attached. We do not provide refunds for products that have been used or damaged.

Art Academy Ireland does not accept responsibility for transportation to and from its workshop. All accommodations, VIS’s parking, transport, flights m, materials purchased are the sole responsibility of the customer. Art Academy Ireland does not cover the loss of travel, accommodation costs in the event of a cancelled class or otherwise.

CHANGES TO WEBSITE

Art Academy reserves the right to:

  • Change or remove (temporarily or permanently) the Website or any part of it without notice.
  • Change these Terms and Conditions at any time.

LINKS TO THIRD PARTY WEBSITES

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and we are not responsible for the content or availability of any such sites.

COPYRIGHT

All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Art Academy Ireland or otherwise used by Art Academy Ireland as permitted by law.

In accessing the Website you agree that you will access the content solely for your personal, non-commercial use.
